1. INTRODUCTION AND ACCEPTANCE

Welcome to VipTravelScout, a luxury travel service operated by Pergi Consulting FZCO, a company duly incorporated and authorized under the laws of the United Arab Emirates. By accessing our website at www.viptravelscout.com, submitting a quote request, or using our services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety.

These Terms and Conditions constitute a legally binding agreement between you (the “Client” or “Guest”) and VipTravelScout, a division of Pergi Consulting FZCO (collectively referred to as “VTS,” “we,” “our”). If you do not agree with any part of these terms, you must not use our website or services.

VipTravelScout operates as an Outbound Tour Operator (intermediaries between clients and partner resorts) specializing primarily in luxury resort accommodations in the Maldives, while also providing services for luxury resorts worldwide. We act exclusively as intermediaries between our clients and partner resorts, facilitating bookings through direct contractual relationships with luxury properties globally. We do not own, operate, or control any of the resorts, hotels, or accommodation facilities featured on our platform.

By using our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are booking on behalf of other travelers, you represent and warrant that you have the authority to bind all members of your travel group to these terms and that all travelers will comply with these conditions.

2. COMPANY INFORMATION AND SERVICES

2.1 Company Details

VipTravelScout is a registered trademark and division of Pergi Consulting FZCO, a limited liability company incorporated under the laws of the United Arab Emirates. Our company operates under License Number 7912005 and maintains its legal headquarters at Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates.

As an authorized Outbound Tour Operator (intermediaries between clients and partner resorts) in the UAE, we are licensed to provide travel organization services and act as intermediaries between clients and accommodation providers. Our operations are conducted in compliance with UAE federal laws, Dubai local regulations, and international travel industry standards.

2.2 Nature of Services

VipTravelScout operates exclusively as an Outbound Tour Operator (intermediaries between clients and partner resorts) specializing primarily in luxury resort accommodations in the Maldives, while also providing booking services for luxury resorts worldwide. Our main services include:

Accommodation Booking Services: We facilitate bookings at carefully selected luxury resorts primarily in the Maldives and other premium destinations worldwide through direct contractual partnerships. Our portfolio includes premium properties offering overwater villas, beachfront accommodations, and all-inclusive packages designed for discerning travelers.

Personalized Consultation: Each client is assigned a dedicated VipTravelScout representative who provides personalized service throughout the booking process and travel experience. Our consultants offer expert advice on resort selection, villa categories, dining options, and special arrangements.

Quote Generation: We provide detailed and customized quotes based on specific client requirements, travel preferences, and budget. Our quotes include transparent pricing, clear payment terms, and comprehensive descriptions of included services.

Payment Processing: We facilitate secure payment processing through multiple payment methods, ensuring safe transactions and compliance with international financial security standards.

2.3 Service Limitations

It is essential to understand that VipTravelScout operates strictly as a booking intermediary and does not:

Own, operate, or control any resort properties
Provide direct accommodation services
Organize or book flights (except through third-party referral services)
Offer travel insurance directly (except through third-party referral services)
Provide local transportation services (except through third-party referral services)
Act as a tour guide or escort service (except through third-party referral services)
Handle visas for entry into the countries of the resorts we propose

Our role is limited to facilitating bookings and serving as the primary point of contact between clients and partner resorts for booking-related matters.

3. BOOKING PROCESS AND PROCEDURES

3.1 Initial Request and Quote

The booking process begins when a client submits a quote request through our website. A dedicated VipTravelScout representative will contact the client within 48 hours during normal business hours.

During the initial consultation, we gather detailed information about the client’s travel requirements, including preferred dates, accommodation type, number of guests, dietary preferences, and special requests. This information allows us to create a personalized quote that meets the client’s specific expectations.

3.2 Quote Validity

Quote Validity Period: All quotes issued by VipTravelScout are valid for a period of fifteen (15) days from the date of issue. After this period, prices and availability are subject to change and a new quote may be required.

The quote validity period is firm and non-extendable. Clients wishing to proceed with a booking must confirm their acceptance within the specified period (15 days) by depositing 15% of the total booking amount. VipTravelScout reserves the right to modify prices or withdraw availability if confirmation and payment of the 15% deposit are not received within 15 days.

3.3 Booking Confirmation and Payment Requirements

A booking is considered confirmed only after:

Receipt of the initial deposit payment as specified.
Issuance of an invoice by VipTravelScout acknowledging receipt of the deposit payment (15%).

Payment Structure: VipTravelScout operates with a two-phase payment system designed to secure bookings:

Initial Deposit: Upon acceptance of a quote, clients must pay a non-refundable deposit of fifteen percent (15%) of the total booking value. This deposit secures the booking and covers administrative costs and initial commitments with partner resorts.

Final Balance: The remaining eighty-five percent (85%) of the total booking value is due within sixty (60) days before the travel departure date. Clients will receive a payment reminder and invoice thirty (30) days before the balance due date.

Bookings Within 60 Days of Departure: For bookings made within sixty (60) days of the intended departure date, the total payment amount (100%) becomes immediately due and payable upon quote acceptance. The two-phase payment system does not apply to last-minute bookings (within 60 days of arrival) due to operational requirements and partner resort policies.

4. PAYMENT METHODS AND PROCESSING

4.1 Accepted Payment Methods

VipTravelScout accepts payments through the following methods with their respective fees:

EU Debit Card Payments: We accept major European Union debit cards. Payments are processed through a secure payment gateway. Fee: 0%

EU Credit Card Payments: We accept major European Union credit cards including Visa, MasterCard, and American Express. Fee: 2.5%

Extra-EU Card Payments: We accept debit and credit cards issued outside the European Union. Fee: 3%

Cryptocurrency Payments: VipTravelScout accepts cryptocurrency payments (stablecoins) including USD Coin (USDC) and Tether (USDT). Fee: 3.5%

Bank Wire Transfer: International bank wire transfers are accepted. All bank wire fees, intermediary charges, and currency conversion costs are borne by the client. Fees: according to client’s bank

PayPal: We accept payments through PayPal for greater convenience and security. Fee: 3%

4.2 Payment Processing

Credit/Debit Card Processing: For card payments, VipTravelScout will provide a secure payment link upon quote acceptance. Payment must be completed within 24 hours of receiving the link to maintain the quoted price and availability.

Cryptocurrency Processing: For cryptocurrency payments, VipTravelScout will provide specific wallet addresses and payment instructions upon quote acceptance. Payment must be made exclusively in USDT or USDC stablecoins. The cryptocurrency amount will be calculated based on the exchange rate at the time of quote acceptance with a 3.5% fee. Payment must be completed within 24 hours of receiving payment instructions to maintain the quoted exchange rate.

Bank Wire Processing: Bank wire instructions will be provided upon quote acceptance. Wire transfers typically require 3-5 business days for international processing. Booking confirmation will be issued only after funds are received and cleared in VipTravelScout’s account.

PayPal Processing: For PayPal payments, VipTravelScout will provide a secure payment link or direct transfer instructions. PayPal payments are processed immediately and booking confirmation is issued within 24 hours of payment receipt.

4.3 Payment Security

VipTravelScout implements rigorous security measures to protect all payment transactions. We do not store credit card information on our systems and all payment data is processed through payment gateways compliant with the highest standards.

For cryptocurrency transactions, we provide secure wallet addresses and use established blockchain networks to ensure transaction security and transparency. All cryptocurrency transactions are recorded on the respective blockchain and provide immutable proof of payment.

Bank wire information is transmitted through secure and encrypted channels, and banking details are not stored on our systems beyond the transaction completion period.

5. CANCELLATION AND REFUND POLICIES

5.1 Cancellation Terms and Conditions

VipTravelScout maintains a structured cancellation policy designed to balance client flexibility with the operational requirements of our partner resorts and business sustainability.

Non-Refundable Deposit: The initial deposit of fifteen percent (15%) of the total booking value is non-refundable under all circumstances. This deposit covers administrative costs, booking processing, and mediation services provided between the client and partner resorts.

Cancellation Timeline and Refund Structure:

Booking Confirmation: 15% non-refundable deposit

Balance: The remaining 85% at least 60 days before arrival

If the booking is cancelled before 60 days from arrival, a refund of 85% is provided if paid in advance. If the 85% balance has not yet been paid and the booking is cancelled within 60 days, nothing will be owed.

Last-Minute Bookings: For bookings made within sixty (60) days of departure, the total balance is required in a single payment with no possibility of refund.

5.2 Cancellation Procedures

All cancellation requests must be submitted in writing via email to info@viptravelscout.com. The cancellation request must include:

Booking number or quote reference
Primary client name
Original travel dates
Reason for cancellation
Contact information for correspondence

VipTravelScout will confirm receipt of the cancellation request within 24 hours and provide a detailed calculation of any applicable refunds according to the terms specified above.

5.3 Refund Processing

Approved refunds will be processed using bank wire transfer or cryptocurrency.

6. LIMITATION OF LIABILITY AND DISCLAIMERS

6.1 Third-Party Service Provider Disclaimer

VipTravelScout operates exclusively as an intermediary between clients and independent third-party service providers. VipTravelScout

expressly disclaims any liability for acts, omissions, negligence, or misconduct of any independent third-party service provider.

Partner resorts are independent commercial entities responsible for the direct provision of accommodation, dining, and activity services. VipTravelScout has no control over the daily operations, service standards, safety, injuries, or policies of these third-party providers.

6.2 Liability Limitations

Under no circumstances shall VipTravelScout be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising from the use of our services or the inability to use our services.

VipTravelScout’s total liability for any claim arising from or relating to these terms or our services shall not exceed the total amount paid by the client to VipTravelScout for the specific services giving rise to the claim.

6.3 Travel Insurance Recommendation

VipTravelScout strongly recommends that all clients purchase comprehensive travel insurance to protect against unforeseen circumstances, medical emergencies, trip cancellations, and other travel-related risks.

Travel insurance can provide coverage for emergency medical expenses, medical evacuation, trip cancellation, trip interruption, lost or delayed baggage, and other unexpected events that could affect travel plans.

6.4 Force Majeure

VipTravelScout shall not be liable for delays, cancellations, or non-performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, pandemics, government actions, or other force majeure circumstances.

7. FLIGHT ORGANIZATION AND THIRD-PARTY SERVICES

7.1 Flight Booking Disclaimer

VipTravelScout does not organize, book, or provide flight services directly. Our website provides access to a flight search engine through our partnership with travelpayouts.com as a convenience for clients.

VipTravelScout expressly disclaims any liability for flight-related issues such as delays, cancellations, or incorrect time zone calculations that may partially or completely compromise the stay.

Clients are completely responsible for:

– Booking and purchasing airline tickets

– Verifying visa and passport requirements

– Timely arrival at the destination according to resort check-in dates

– Coordinating airport transfers

– Managing any flight issues or delays

7.2 Time Zone Considerations

Clients must carefully consider time zone differences when booking flights to ensure timely arrival for resort check-in/check-out or connections with departing flights. VipTravelScout provides general time zone information but is not responsible for calculation errors that could affect stay dates or departure.

7.3 Third-Party Referral Services

When we provide links or referrals to third-party services such as travelpayouts.com, these are provided exclusively for client convenience. VipTravelScout does not endorse, guarantee, or assume responsibility for the services, products, or content provided by these third parties.

8. DATA PROTECTION AND PRIVACY

8.1 Data Collection and Use

VipTravelScout collects and processes personal information necessary to provide our booking services. This includes contact information, travel preferences, payment information, and other data relevant to facilitating bookings.

8.2 Data Sharing

We share client information with partner resorts only to the extent necessary to complete bookings and provide requested services. We do not sell, rent, or share personal information with third parties for marketing purposes without explicit consent.

8.3 Data Security

We implement appropriate security measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure.

9. APPLICABLE LAW AND JURISDICTION

9.1 Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai, without regard to conflict of law principles.

9.2 Jurisdiction and Venue

Any legal dispute shall be subject to the exclusive jurisdiction of the Courts of Dubai, United Arab Emirates. The parties irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

9.3 Dispute Resolution

Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute through good faith negotiation. If negotiation fails, the parties may proceed with mediation or arbitration according to the rules of the Dubai Chamber of Commerce.

10. GENERAL PROVISIONS

10.1 Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties regarding the subject matter contained herein and supersede all prior agreements, understandings, and communications, whether written or oral.

10.2 Modifications

VipTravelScout reserves the right to modify these Terms and Conditions at any time. Modifications will become effective immediately

upon posting on our website. Continued use of our services after such modifications constitutes acceptance of the revised terms.

10.3 Severability

If any provision of these Terms and Conditions is deemed invalid or unenforceable, such provision shall be eliminated and the remaining provisions shall remain in full force and effect.

10.4 Waiver

The failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
